AN ACT concerning school district finance; affecting the determination of low enrollment weighting; amending K.S.A. 1996 Supp. 72-6412 and 72-6412a and repealing the existing sections. Be it enacted by the Legislature of the State of Kansas: Section 1. K.S.A. 1996 Supp. 72-6412 is hereby amended to read as follows: 72-6412. For the school year in which the provisions of K.S.A. 1996 Supp. 72-6442, and amendments thereto, become operational and each school year thereafter, the low enrollment weighting of each district with under 1,800 enrollment shall be determined by the state board as follows: (a) Determine the amount of the median budget per pupil for the 1991-92 school year of districts with 75-125 enrollment in such school year; (b) determine the amount of the median budget per pupil for the 1991-92 school year of districts with 200-399 enrollment in such school year; (c) determine the amount of the median budget per pupil for the 1991-92 school year of districts with 1,900 or over enrollment; (d) prescribe a schedule amount for each of the districts by preparing a schedule based upon an accepted mathematical formula and derived from a linear transition between (1) the median budgets per pupil deter- mined under (a) and (b), and (2) the median budgets per pupil deter- mined under (b) and (c). The schedule amount for districts with 0-99 enrollment is an amount equal to the amount of the median budget per pupil determined under (a). The schedule amount for districts with 100- 299 enrollment is the amount derived from the linear transition under (1). The schedule amount for districts with 300-1,899 enrollment is the amount derived from the linear transition under (2); (e) for districts with 0-99 enrollment: (1) Subtract the amount determined under (c) from the amount de- termined under (a); (2) divide the remainder obtained under (1) by the amount deter- mined under (c); (3) subtract from enrollment of the district in the current school year the number of pupils, if any, who do not meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in the district; (3) (4) multiply the quotient obtained under (2) by the enrollment of the district in the current school year. The product is the low enrollment weighting of the district remainder obtained under (3); (5) determine the number of pupils subtracted from enrollment under (3), if any, who meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in a district with 100-299 enrollment and multiply the quotient obtained under (f)(2) by the number of pupils de- termined under this provision; (6) determine the number of pupils subtracted from enrollment under (3), if any, who meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in a district with 300-1,799 enrollment and multiply the quotient obtained under (g)(2) by the number of pupils determined under this provision; (7) determine the number of pupils subtracted from enrollment under (3), if any, who meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in a district with 1,800 or over enrollment and multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 Supp. 72-6442, and amendments thereto, by the number of pupils deter- mined under this provision; (8) add the products obtained under (5), (6) and (7) to the product obtained under (4). The sum is the low enrollment weighting of the dis- trict; (f) for districts with 100-299 enrollment: (1) Subtract the amount determined under (c) from the schedule amount of the district; (2) divide the remainder obtained under (1) by the amount deter- mined under (c); (3) subtract from enrollment of the district in the current school year the number of pupils, if any, who meet the requirements of K.S.A. 72- 1046, and amendments thereto, for attendance at school in a district with 300 or over enrollment; (4) multiply the quotient obtained under (2) by the enrollment of the district in the current school year. The product is the low enrollment weighting of the district remainder obtained under (3); (5) determine the number of pupils subtracted from enrollment under (3), if any, who meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in a district with 300-1,799 enrollment and multiply the quotient obtained under (g)(2) by the number of pupils determined under this provision; (6) determine the number of pupils subtracted from enrollment under (3), if any, who meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in a district with 1,800 or over enrollment and multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 Supp. 72-6442, and amendments thereto, by the number of pupils deter- mined under this provision; (7) add the products obtained under (5) and (6) to the product ob- tained under (4). The sum is the low enrollment weighting of the district; (g) for districts with 300-1,799 enrollment: (1) Subtract the amount determined under (c) from the schedule amount of the district; (2) divide the remainder obtained under (1) by the amount deter- mined under (c); (3) subtract from enrollment of the district in the current school year the number of pupils, if any, who meet the requirements of K.S.A. 72- 1046, and amendments thereto, for attendance at school in a district with 1,800 or over enrollment; (4) multiply the quotient obtained under (2) by the enrollment of the district in the current school year remainder obtained under (3). The product is the low enrollment weighting of the district.; (5) multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 Supp. 72-6442, and amendments thereto, by the number of pupils, if any, subtracted from enrollment under (3); (6) add the product obtained under (5) to the product obtained under (4). The sum is the low enrollment weighting of the district. (h) In determining low enrollment weighting under this section, the state board shall determine the district in which each pupil, not meeting the requirements of K.S.A. 72-1046, and amendments thereto, for atten- dance at school in the district in which enrolled, is entitled to attend school under the provisions of K.S.A. 72-1046, and amendments thereto. Sec. 2. K.S.A. 1996 Supp. 72-6412a is hereby amended to read as follows: 72-6412a. (a) For any school year in which the provisions of K.S.A. 1996 Supp. 72-6442a, and amendments thereto, are operational, the state board shall determine the districts having 1,800-1,899 or under 1,800-1,850 enrollment that are entitled to assignment of low enrollment weighting and shall determine the low enrollment weighting of each such district as follows: (1) Determine the amount of the median budget per pupil for the 1991-92 school year of districts with 75-125 enrollment in such school year; (2) determine the amount of the median budget per pupil for the 1991-92 school year of districts with 200-399 enrollment in such school year; (3) determine the amount of the median budget per pupil for the 1991-92 school year of districts with 1,900 or over enrollment; (4) prescribe a schedule amount for each of the districts by preparing a schedule based upon an accepted mathematical formula and derived from a linear transition between (A) the median budgets per pupil de- termined under (1) and (2), and (B) the median budgets per pupil de- termined under (2) and (3). The schedule amount for districts with 300-1,899 enrollment is the amount derived from the linear transition under (B); (5) for districts with 0-99 enrollment: (A) Subtract the amount determined under (3) from the amount de- termined under (1); (B) divide the remainder obtained under (A) by the amount deter- mined under (3); (C) subtract from enrollment of the district in the current school year the number of pupils, if any, who do not meet the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in the district; (C) (D) multiply the quotient obtained under (B) by the enrollment of the district in the current school year. The product is the low enroll- ment weighting of the district remainder obtained under (C); (E) determine the number of pupils subtracted from enrollment under (C), if any, who meet the requirements of K.S.A. 72-1046, and amend- ments thereto, for attendance at school in a district with 100-299 enroll- ment and multiply the quotient obtained under (6)(B) by the number of pupils determined under this provision; (F) determine the number of pupils subtracted from enrollment under (C), if any, who meet the requirements of K.S.A. 72-1046, and amend- ments thereto, for attendance at school in districts with 300-1,850 en- rollment that are determined to be entitled to assignment of low enroll- ment weighting and multiply the quotient obtained under (7)(B) by the number of pupils determined under this provision; (G) determine the number of pupils subtracted from enrollment under (C), if any, who meet the requirements of K.S.A. 72-1046, and amend- ments thereto, for attendance at school in districts with 1,850 or over enrollment and multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 Supp. 72-6442a, and amendments thereto, by the number of pupils determined under this provision; (H) add the products obtained under (E), (F) and (G) to the product obtained under (D). The sum is the low enrollment weighting of the dis- trict; (6) for districts with 100-299 enrollment: (A) Subtract the amount determined under (3) from the schedule amount of the district; (B) divide the remainder obtained under (A) by the amount deter- mined under (3); (C) subtract from enrollment of the district in the current school year the number of pupils, if any, who meet the requirements of K.S.A. 72- 1046, and amendments thereto, for attendance at school in a district with 300 or over enrollment; (D) multiply the quotient obtained under (B) by the enrollment of the district in the current school year. The product is the low enrollment weighting of the district remainder obtained under (C); (E) determine the number of pupils subtracted from enrollment under (C), if any, who meet the requirements of K.S.A. 72-1046, and amend- ments thereto, for attendance at school in districts with 300-1,850 en- rollment that are determined to be entitled to assignment of low enroll- ment weighting and multiply the quotient obtained under (7)(B) by the number of pupils determined under this provision; (F) determine the number of pupils subtracted from enrollment under (C), if any, who meet the requirements of K.S.A. 72-1046, and amend- ments thereto, for attendance at school in districts with 1,850 or over enrollment and multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 Supp. 72-6442a, and amendments thereto, by the number of pupils determined under this provision; (G) add the products obtained under (E) and (F) to the product ob- tained under (D). The sum is the low enrollment weighting of the district; (7) for districts with 300 enrollment to districts within the 1,800-1,899 300-1,850 enrollment interval that are determined to be entitled to as- signment of low enrollment weighting: (A) Subtract the amount determined under (3) from the schedule amount of the district; (B) divide the remainder obtained under (A) by the amount deter- mined under (3); (C) subtract from enrollment of the district in the current school year the number of pupils, if any, who meet the requirements of K.S.A. 72- 1046, and amendments thereto, for attendance at school in districts not entitled to assignment of low enrollment weighting; (D) multiply the quotient obtained under (B) by the enrollment of the district in the current school year remainder obtained under (C). The product is the low enrollment weighting of the district.; (E) multiply the quotient obtained under subsection (a)(2) of K.S.A. 1996 supp. 72-6442a, and amendments thereto, by the number of pupils, if any, subtracted from enrollment under (C); (F) add the product obtained under (E) to the product obtained under (D). The sum is the low enrollment weighting of the district. (b) For the purpose of determining the districts within the 1,800- 1,899 enrollment interval that are entitled to assignment of low enroll- ment weighting, the state board shall determine the lowest enrollment district that is entitled to assignment of correlation weighting and subtract one. Districts with enrollment equal to or under the remainder are en- titled to assignment of low enrollment weighting. (c) The provisions of this section shall take effect on July 1, 1995, and shall be in force until the provisions of K.S.A. 1996 Supp. 72-6442, and amendments thereto, become operational. In determining low enrollment weighting under this section, the state board shall determine the district in which each pupil, not meeting the requirements of K.S.A. 72-1046, and amendments thereto, for attendance at school in the district in which enrolled, is entitled to attend school under the provisions of K.S.A. 72- 1046, and amendments thereto. Sec. 3. K.S.A. 1996 Supp. 72-6412 and 72-6412a are hereby re- pealed. Sec. 4. This act shall take effect and be in force from and after its publication in the statute book.
