AN ACT concerning animals; relating to the testing of equidae for equine
infectious anemia.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) As used in this section:
(1) ``Equidae'' means a family of perissodactyl ungulate mammals
containing a single genus equs, which includes, but is not limited to,
horses, asses, jacks, jennies, hennies, mules, donkeys, burrows, ponies and
zebras.
(2) ``Equine exhibitions'' shall include, but not be limited to, fairs,
livestock shows, breed association shows, rodeos, racetracks, jackpots and
other equidae concentration points.
(b) Except as provided in subsection (c) and (d), all equidae which
are offered for sale, sold, bartered or traded within the state of Kansas
shall be accompanied by a record of an official negative test result for
equine infectious anemia conducted at an approved laboratory within the
previous 12 months.
(c) Except as provided in subsection (d), all equidae offered for sale
or sold at a public livestock market shall meet one of the following
requirements:
(1) Be accompanied by an official negative test result for equine in-
fectious anemia conducted at an approved laboratory within the previous
12 months;
(2) have a blood test taken by an accredited veterinarian at the public
livestock market and obtain an official negative test result for equine
infectious anemia before leaving the market; or
(3) have a blood test taken by an accredited veterinarian at the public
livestock market and be quarantined at a premise until an official negative
test result for equine infectious anemia is obtained.
(d) No test for equine infectious anemia shall be required if the equi-
dae:
(1) Is purchased at a public livestock market by a licensed livestock
dealer and consigned to an approved slaughter establishment;
(2) that is offered for sale if returned to the premise of origin prior
to sale; or
(3) is a foal under six months of age which is nursing and is sold with
a dam which has an official negative test result for equine infectious ane-
mia within the previous 12 months.
(e) All equidae moving within the state of Kansas to equine exhibi-
tions shall be accompanied by a record of an official negative test result
for equine infectious anemia conducted at an approved laboratory within
the previous 12 months.
(f) The management of the equine exhibitions shall be responsible
for verifying that all equidae entering such exhibitions meet the testing
requirements, but shall not be responsible for recording or accepting false
or erroneous information provided by the owner, trainer or exhibitor of
the equidae.
(g) The livestock commissioner shall adopt rules and regulations to
implement the provisions of this section. Such rules and regulations shall
include procedures for the approval of laboratories conducting such tests.
(h) Any person who violates the provisions of this section or any rule
and regulation adopted pursuant to this section, upon conviction, shall be
fined not less than $100 nor more than $500.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
